Former CPI(M) leader seeks monitoring of probe into attack on him

Former Communist Party of India (Marxist) leader C.O.T. Nazeer has filed a petition in the Judicial First Class Magistrate (JFCM) court at Thalassery pleading for the court’s monitoring of investigation in the case of the attempt to murder him by suspected party workers on May 18.

In the petition submitted before the JFCM on September 2 Mr. Nazeer also sought the court’s direction to the investigating officer to record his statement before the judicial magistrate under Section 164 of the Code of Criminal Procedure.

Mr. Nazeer, estranged CPI(M) leader and former councillor in Thalassery municipal council, had suffered serious stab injuries in the attack by a three-member group of assailants at Thalassery.

There are total 13 accused in the case including those who allegedly hatched criminal conspiracy and provided arms.

Conspiracy factor

In his petition, Mr. Nazeer alleged that Thalassery MLA and CPI(M) leader A.N. Shamseer had motive for hatching conspiracy to eliminate him.

There was serious corruption charge in connection with the renovation of the Municipal Stadium at Thalassery in which Mr. Shamseer was involved, the petitioner said.

On the day of the inauguration of the renovated stadium, activists of a local club associated with the petitioner, had distributed pamphlets against the manner in which the stadium renovation was made, he said. When the activists had tried to give the pamphlet to Sports Minister E.P. Jayarajan at the inaugural function on December 31, the MLA had snatched it away and said on the stage that the petitioner would have to pay a high price for the protest by the club activists.

The petitioner also alleged that when he had contested in the Vadakara Lok Sabha constituency as an independent, Mr. Shamseer told him that “if he contested in the election, his hands and legs would be amputated. Alleging faulty investigation due to political intervention, Mr. Nazeer said in his petition that the Circle Inspector and Sub Inspector who had probed the cases had been transferred suddenly.

Citing a Supreme Court judgement, the petitioner said that the JFCM had powers to issue appropriate directions to the investigating officer and monitor the investigation.
