There were no lapses on his part to comply with a Kerala High Court directive not to transfer Bitty Mohanty, a rape convict, to any other jail, according to a statement filed by Kannur Special Sub- jail Superintendent K.V. Jagadeesan on Wednesday in the High Court
Bitty was arrested on March 8 on charges of impersonation, forgery and cheating while working in one of the branches of the SBT in Kannur as a trainee officer allegedly under a false name, Raghav Ranjan.
He said in the statement that the Superintendent, Central Prison, Jaipur, Rajasthan, had intimated in writing to him several times that Bitty Mohanty was a convict who had jumped parole. He was released on parole on December 4, 2006.
He said that orders releasing him on bail were received from the Judicial First Class Magistrate Court, Payyannur, along with two letters from the Superintendent, Central Jail, Jaipur. The Payyannur Magistrate court also asked the Superintendent to take necessary action on the basis of the letters from the Jaipur Jail Superintendent. In another letter, the Jaipur Central Jail Superintendent had requested him not to release Bitty Mohanty from custody, since he was wanted there.
In fact, it was at 12.40 p.m. on December 6, 2013 that Bitty Mohanty had been sent to Jaipur under a proper police escort for producing him before the Additional Chief Metropolitan Magistrate Court, Jaipur. The jail office came to know about the High Court order by about 3.45 p.m. on the same day over phone. However, his efforts to get in touch with the police escort party over phone to bring the prisoner back to jail ended in vain. The Assistant Commandant, AR Camp, Kannur had then been requested to take urgent steps to bring the prisoner back. He was thus brought back to Kannur Special Jail on December 9 and is now kept in jail, he said.
