The Kerala High Court on Thursday declined a plea of counsel for one of the accused in an actor assault case, involving actor Dileep, to recall its order directing to expedite the proceedings and complete the trial in six months.
When counsel for second accused Martin made the submission before Justice Alexander Thomas, senior government pleader Suman Chakravarthy, taking exception to the plea, said it was part of a bid to delay the trial.
No changes
The court observed that counsel had let the cat out of the bag now, adding that no changes could be made in a signed order.
The judge passed the directive for expediting the trial while dismissing a bail petition filed by the second accused and driver of the vehicle in which the woman actor was travelling.
The court also directed the trial court to take necessary steps to frame the charges against the accused. The petitioner argued that he had been incarcerated for two years without bail even while the key conspirator, actor Dileep, was out on bail.
Transfer of case
The High Court had recently transferred the case to a CBI special court headed by a woman judge from the Ernakulam sessions court on a petition moved by the survivor.
