Action proposed against CI, SI for falsely implicating woman

The Kerala State Police Complaints Authority (KSPCA) has suggested that State Police Chief T.P. Senkumar initiate suitable disciplinary action against former Punalur Circle Inspector R. Vijayan and Sub-Inspector K.S. Gopakumar for falsely implicating a woman in a culpable homicide attempt case under Section 308 of the IPC.

The woman, Bincy Alex of Punalur, was arrested and remanded in the Kottarakara sub-jail for 14 days. The verdict of the KSPCA, with former Madras High Court Acting Chief Justice K. Narayana Kurup as Chairman and former Director General of Police K.P. Somarajan and retired district judge P. Muralidharan as members, was delivered on October 1.

Lawyer Paripally R. Raveendran, who appeared for Ms. Alex before the KSPCA, said she was a mother of two and her husband was employed abroad. The incident in question was an altercation between Ms. Alex and her neighbour.

Police charge

The police charge was that she tried to stab the neighbour in the neck with a knife.

After being released on bail, she lodged a complaint with the then State Police Chief against the two police officers. An inquiry was ordered and the findings of the Kottarakara Deputy Superintendent of Police was that there were no grounds to charge Ms. Alex under Section 308 of the India Penal Code and that she was falsely implicated.

Mr. Raveendran said the two officers later filed a charge against Ms. Alex before the Kottarakara Assistant Sessions Court. It was following this that she moved the KSPCA. In the order, Justice Kurup observed that falsely implicating the complainant in a criminal case was a stark failure of the justice delivery system.
