Recusal of judge:court seeks files

A Division Bench of the Kerala High Court on Wednesday directed the government to produce the files leading to the preparation and filing of the petition seeking recusal of Justice C.N. Ramachandran Nair from the Bench hearing the government's review petition on prohibition of roadside meetings.

The Bench comprising Justice C.N. Ramachandran Nair and Justice P.S. Gopinathan criticised the government for filing such a petition. It observed that it was unfortunate that it was filed by an Additional Secretary. The court wanted to know which legal officer had prepared such a petition. The court orally termed the filing of such a petition as irresponsible and orally observed that it amounted to “scandalising” the court.

The court orally made these observations when the arguments on the review petition resumed on Wednesday.

The petition will be taken up for hearing on July 30.
