Lokayukta counsel for filing plea in apex court


Counsel for the Lokayukta has recommended that an appeal should be filed before the Supreme Court against the Karnataka High Court judgment quashing a part of the Lokayukta report and the FIR against the former Chief Minister B.S. Yeddyurappa.

In his legal opinion, Special Counsel for the Lokayukta B.A. Belliappa has informed the Upalokayukta that the High Court verdict, while allowing Mr. Yeddyurappa's petition on the ground of violation of principles of natural justice, has “incidentally touched upon the merits of the matter without substantiating with reasons, which is without considering the materials on record.”

“Objection was filed on behalf of the Lokayukta police and the records pertaining to the issue were also furnished to the High Court. The Honourable High Court, failing to consider the objections and materials placed by the Lokayukta police, has erroneously passed the judgment in question without considering the materials on record and ignoring the principles/law laid down by this Hon'ble Court…,” Mr. Belliappa stated in the opinion.

Regarding the findings in the verdict that principle of natural justice was violated [which means no notice was issued to Mr. Yeddyurappa before making recommendation against him by the Lokayukta], Mr. Belliappa stated in the opinion that there was no need to issue notice to the persons named in the report submitted under Section 7(2-A) of the Karnataka Lokayukta Act unlike under Section 9(1) of the Act.
