Despite a strong legal opinion from the Advocate General of the State asking the Karnataka government to file an appeal in the Supreme Court against the acquittal of Chief Minister Jayalalithaa by the High Court in the disproportionate assets case, the Siddaramaiah government is yet to take a final decision on the matter.
Though the issue was on the Cabinet’s agenda on Monday, the meeting presided over by Mr. Siddaramaiah did not discuss the matter.
Sources said the matter was not discussed since the Cabinet needed some clarifications from Advocate General Ravivarma Kumar who is learnt to have advised the State government to file an appeal “as soon as possible”.
Special Public Prosecutor in the case, B V Acharya, had also claimed that the High court judgment had “calculation errors” and advised the government to file an appeal in the apex court.
While the Karnataka government has three months time to file an appeal, sources claimed that since “it is a politically sensitive matter” the government is studying the issue closely. “Eventually the government will have to file an appeal as the legal opinion on the matter is strong and unanimous,” said the sources.
It was listed but not taken up for discussion as some clarifications from Advocate General were awaited
