The habeas corpus writ petition, filed on behalf of human rights activist Sudha Bharadwaj in the Punjab and Haryana High Court, was withdrawn on Wednesday in the light of the Supreme Court’s order that gave the accused time to seek legal remedy from a lower court.
“The court asked counsel to withdraw the present habeas corpus petition with liberty to seek remedies as per law in the wake of the recent Supreme Court’s order, which gave the accused four weeks to take legal remedy,” advocate Ankit Agarwal, who had filed the petition on behalf of Ms. Bharadwaj, told The Hindu .
Arrested inAugust
The petition was filed on August 28 when Ms. Bhardwaj was arrested by the Maharashtra police from her home at Badarpur in Faridabad.
Last week, the Supreme Court held that the arrest of five activists — Varavara Rao, Ms. Bhardwaj, Arun Ferreira, Vernon Gonsalves and Gautam Navlakha — in the Bhima-Koregaon violence case was not an attempt to silence dissent.
However, the court gave the accused four weeks to take legal remedy and seek bail from a lower court.
