The Bombay High Court on Monday decided that it will commence the final hearing on Pune German bakery blast accused Mirza Himayat Baig's death sentence confirmation from April 8.
The court will also hear Baig's appeal against death sentence from the same date.
A Pune court had awarded him death penalty for his involvement in the 2010 German Bakery blast case, after the Maharashtra Anti-Terrorism Squad (ATS) investigated and filed a chargesheet against him.
After the matter came to the High Court for confirmation of sentence, journalist Ashish Khetan had filed a Public Interest Litigation against the conviction. He claimed that the “ATS has deliberately created bogus evidence, extracted false confessions by the most inhuman torture, planted explosives in the houses of the accused and thus implicated innocent Muslim youth.”
Even the Maharashtra State Minorities Commission filed an intervention against the youth's conviction. The court had tagged all these matters together in the past.
Previously, a division bench of the court had recused itslef from hearing Baig's plea. On Monday, it posted the matter for April 8.
