A Delhi court on Wednesday directed the Delhi Police to request the Delhi Government to expedite sanction to prosecute former JNU Students’ Union president Kanhaiya Kumar and others in a sedition case.

The case pertains to the raising of “objectionable” slogans at the event in 2016 against the hanging of Parliament attack mastermind Afzal Guru.

Granting more time to the police to get obtain the mandatory sanction, Metropolitan Magistrate Deepak Sherawat adjourned the case to Feb 28.

The magistrate had on last date refused to take cognisance of the chargesheet stating that the Delhi police filed it without sanction for prosecution. The probe agency had then promised to get the required sanction within ten days.

According to Section 196 of the Criminal Procedure Code, “no court shall take cognisance of any offence punishable under Chapter VI of the IPC.” And 124-A (sedition) under which the accused persons have also been charge sheeted is placed under this chapter.
