The Supreme Court on Friday issued notice to the former Satyam chairman, B. Ramalinga Raju, on the CBI's appeal for cancelling the bail granted to him by the Andhra Pradesh High Court in the accounting scam.
A Bench of Justices Dalveer Bhandari and Deepak Verma issued the notice, asking Mr. Raju to show-cause why his bail, granted on August 18, should not be cancelled. The Bench directed the matter to be listed on October 19, along with other petitions filed by the CBI challenging the bail granted to his brother Rama Raju and some employees.
Solicitor-General Gopal Subramaniam submitted that Mr. Raju was not well and was undergoing treatment in a hospital.
The CBI said in its appeal that the High Court had failed to consider that grant of bail at this stage would result in miscarriage of justice, as Mr. Raju's role in the conspiracy was serious and grave. It argued that the grant of bail was unwarranted as sufficient evidence of his role was placed on record. The High Court, the CBI said, had failed to see that the basic objective of criminal jurisprudence would be defeated if the accused was set free after committing serious economic offences. The CBI sought quashing of the order and an interim stay on its operation.
