Supreme Court allows minor repairs at U.P. memorial

The Supreme Court on Tuesday permitted the Mayawati government to undertake certain minor repairs at the Kanshiram Smarak Sthal and to remove construction material from various sites.

A Bench comprising Justice H.S. Bedi and Justice A.K. Patnaik, however, made it clear that the interim stay order on all construction activities passed on September 11, 2009 and October 6, 2009 would continue to be in force.

‘Constitute Bench’

The Bench passing orders on petitions filed by the State of UP and others requested the Chief Justice of the Allahabad High Court to constitute an appropriate Bench to hear all the connected petitions pending in the court and dispose of all these matters in four months.

The Bench said that during the pendency of the petitions in the High Court, the State government could carry out the works at different project sites — the Kanshiram Smarak Sthal, the removal of unutilised construction materials, stone waste and broken stone heaps, removing temporary construction and labour hutments, planting of new saplings, and the rectification of leakages in water supply lines.

At Ramabai Ambedkar Maidan, the State was allowed to remove unutilised building material and scaffoldings. At Dr. Bhimrao Ambedkar Sthal, it was permitted to carry out repairs to the water supply line, plant new saplings, and remove temporary constructions, labour hutments and unutilised construction materials.

Notice discharged

The Bench said: “We have perused the reply filed by the Chief Secretary, State of U.P., to the suo motu notice of contempt and we find that there has been no construction of any kind after September 11, 2009. We, therefore, discharge the suo motu notice of contempt issued to him.”

The Bench disposed of the special leave petition, transfer petition and contempt petition, and said this order would not affect the proceedings in any other SLP or civil appeals pending in the Supreme Court.
