SC transfers Sun TV petition to 2G Bench

ED submits that there was no "likelihood" of attachment during this weekend.

The Supreme Court on Friday transferred to its Special Bench hearing 2G Spectrum cases a petition filed by Sun TV, challenging the >Enforcement Directorate’s attachment order of assets worth Rs. 742 crore in connection with the Aircel-Maxis case.

A Bench led by Justice Dipak Misra directed the petition to be listed before the 2G Bench on Monday, even as the ED submitted that there was no “likelihood” of attachment during this weekend.

In the order, Justice Misra said the 2G Bench would come to a decision whether the matter in the petition actually comes within the “ambit and sweep” of the Spectrum scam or not.

Additional Solicitor General P.S. Narasimha for ED, when asked by the court, said that prima facie the assets seemed to be connected to the 2G scam. Justice Misra observed it was better if the 2G Bench took the decision whether to retain the petition or, in the alternative, refer it to another apex court Bench. Sun TV maintained the assets were acquired much before the agencies started their investigations into the Aircel-Maxis case.
