A special court for CBI cases on Wednesday sentenced four Municipal Corporation of Delhi (MCD) officials to four years imprisonment in the CWG street lights scam.

They are Superintending Engineer D.K. Sugan, Executive Engineer O.P. Mahla, accountant Raju V. and tender clerk Gurcharan Singh.

This is the first of the several cases registered by the CBI in the scam in which the court has held the accused guilty and awarded sentence.

Special judge Brijesh Garg also sentenced two executives of a private company — Sweska Powertech Engineering Pvt Ltd — in the case.

He awarded six years imprisonment to its managing director T.P. Singh and four years jail to director J.P. Singh. The company was slapped with a fine of Rs. 1 lakh to be paid by the two convicted executives.

All the convicts who were on bail were later taken into custody and then to the Tihar jail.

The court had on Monday held all the accused guilty of causing a loss of Rs. 1.42 crore to the MCD in the scam under various provisions of the Prevention of Corruption Act and the Indian Penal Code.

Maximum punishment

Counsel for the investigating agency argued that the convicts should be awarded the maximum punishment of seven years as provided in the corruption law.

Convicts’ counsel sought lenient punishment, arguing that they had no criminal past and had already spent around 11 months in jail during the trial.

The court, in its 124-page judgment, said that the testimonies of prosecution witnesses successfully proved the case beyond the shadow of doubt that all the accused persons had connived together, and in pursuance of criminal conspiracy, various illegal acts were committed by them.
