Senior advocate of Gauhati High Court Hafiz Rashid Ahmed Choudhury on Tuesday filed a criminal case against Assam Chief Minister Tarun Gogoi, his wife Dolly Gogoi, Chief Secretary P.C. Sarma and Additional Director General of Police Dilip Bora for cutting and eating a cake with the colours of the national flag at the Raj Bhavan on Republic Day.

The Court of Chief Judicial Magistrate, Kamrup, has fixed February 15 for deciding on the admissibility of the case. Counsel appearing for Mr. Choudhury argued that Mr. Gogoi’s actions were violative of Section 2 of the Prevention of Insult to the National Honour Act, and he was liable to be punished with imprisonment for a term of up to three years.

Mr. Gogoi said he had already expressed regret for his actions, which he said, were unintentional.
