TDR rule change to benefit over 500 housing societies

Move takes into account concerns of BMC, developer lobby

Mumbai: The State government is likely to give transferable development rights (TDR) to redevelopment projects of housing societies located on internal roads and those in need of right of way. TDR is issued to a landowner as compensation for space ceded to the government for amenities.

Senior government officials said the decision by the Urban Development Department (UDD) would benefit over 500 housing societies. The decision was taken following a request from the local city corporation and the developer lobby. The UDD will soon announce the change in rules.

Most housing societies that are up for redevelopment are located in Chembur, Ghatkopar, Santacruz, Khar and Juhu, where TDR is not given to redevelopment projects abutting internal roads and right of ways.

TDR is issued only for municipal roads, public roads, pre-merger layout roads and road alignments marked by the Brihanmumbai Municipal Corporation (BMC).

Till now, redevelopment projects on private and internal roads had been stuck as the BMC had stopped issuing TDR.

A senior official said that private roads abutting or fronting building layouts do not get TDR when the structures go for redevelopment. BMC chief Ajoy Mehta, in his report to the UDD this week, said, “The BMC is receiving proposals for utilisation of TDR for development of the building abutting existing layout roads, right of ways, and non-BMC roads. The UDD must issue a clarification on it.”

Sources said the issue of not issuing TDR for projects on private roads and right of ways was raised by many developer bodies, including the Maharashtra Chamber of Housing Industry (MCHI-CREDAI) in a meeting of UDD officials this week.

Notification this week

TDR is generated and raised under Regulation 34 of the Development Control Rules. The rule states that a BMC road with a width of nine metres and abutting any structure is issued a TDR. The developer can use the TDR elsewhere in the city. A UDD official said, “The rule was further relaxed to six metres to ease development. We will issue a decision and notification in this regard this week.”
