Sohrabuddin: ‘CBI probe premeditated’


Special court criticises investigation

In the judgment acquitting all 22 accused in the Sohrabuddin Shaikh, Kausar Bi and Tulsiram Prajapati murder cases, the Central Bureau of Investigation (CBI) court on Friday said, “it clearly appears that CBI was more concerned in establishing a particular preconceived and premeditated theory rather than finding out the truth.”

Special CBI Judge S.J. Sharma, in the judgment, said, “The CBI was doing something other than reaching the truth of these offences. My predecessor (Judge M.B. Gosavi) while passing an order of discharge in the application of accused number 16 (BJP president Amit Shah) clearly recorded that the investigation was politically motivated.”

The CBI had before it a premeditated theory and a script intended to implicate political leaders, he said. The agency did what was required to reach that goal rather than conducting an investigation in acordance with law, he said.

Talking about Kausar Bi, Mr. Sharma said, “There is nothing to prove her existence, so how can her disappearance be proved? And there is nothing to prove that the third person travelling with Sohrabuddin and Kausar Bi was Tulsiram.”

Mr. Sharma further said, “The entire investigation was thus targeted to act upon a script to achieve the said goal and in the process of its zeal to any how implicate political leaders and the CBI created the evidence and placed statements purported to have been recorded in charge sheet.”

He said, “Section 164 (recording of confessions and statements) CrPC statements could not withstand the judicial scrutiny of the court and the witnesses deposed fearlessly in the court, clearly indicating that their statements were wrongly recorded by CBI during investigation to justify its script to implicate political leaders.”

Mr. Sharma, who retires on December 31 said, “I have also noted the negligence of the CBI towards the material part of the investigation which clearly indicates that they hurriedly completed the investigation either by using replica of the earlier recorded investigation and have implicated the police personnel who had no knowledge of any conspiracy, rather they appeared innocent.”
