Pune Cong leader held for sexual assault

A builder-politician from Pune was arrested on Friday for allegedly sexually assaulting his employee over the last one year.

According to Bandra police, accused Shivanand Hulyalkar, 38, had assaulted the victim, aged 23, while on a business trip to Mauritius and started stalking and threatening her after she tried to sever ties with him.

Police said Hulyalkar, a member of the Congress party, runs a construction business in Pune and visits Mumbai frequently. The victim, a Jammu native who stays alone in Mumbai, was working with a leading city hotel when she first became acquainted with Hulyalkar around a year ago.

In her complaint, the victim said she met Hulyalkar at a get-together held at a common friend’s residence. She added, “From the next morning, he started messaging, asking to meet me so he could help me with my career. After we met a few times, he made me quit my job, telling me he would employ me in his company. He offered me various posts like CEO, executive director and brand ambassador, and promised a two per cent stake in the company.”

After quitting her job, she started travelling with Hulyalkar on his business trips, and he subsequently gave her a 39 per cent stake in his company and bought her a residence in Bandra.

However, he named himself as an equal owner of the house, and they started living there together. It was after moving in with her that he started physically abusing her, police said.

The victim has alleged in her complaint that earlier this month, she travelled with Hulyalkar to Mauritius and were in a hotel when he forced her into unnatural intercourse on the night of June 20. The victim returned to Mumbai the next day and tried to cut off all relations with him. However, he allegedly kept stalking her and threatening her with dire consequences, after which she approached the police.

Senior PI Pandit Thackeray, Bandra police station, said, “We have recorded the victim’s statement and subjected her to medical tests, after which an FIR was registered against Hulyalkar on Friday. Acting on our instructions, she called up Hulyalkar, who was in Mumbai, and asked him to meet her near Bhabha Hospital. We took him to the police station for inquiries as soon as he reached the spot, and placed him under arrest late on Friday night,” said .

Hulyalkar has been charged with rape, unnatural sex, assault and criminal intimidation under the IPC.

After being produced in court on Saturday, he was remanded in police custody till June 29. Police said he has been a Congress party worker for several years and had tried to get a ticket for the Vidhan Sabha elections from Kasba Vidhan Sabha seat in Pune in 2009, but was denied one.

An update (May, 2020)

Senior police inspector Pandit Thackeray, who was in charge of the Bandra police station when the case against Mr Hulyalkar was registered, told The Hindu that he was released after the complainant filed an application seeking to withdraw her charges. Mr Hulyalkar, after an investigation, was arrested in August 2019, and the complainant filed the application on the same day that his custody period expired.

“The complainant had said in her application that she had filed the complaint in a fit of rage, and that she wished to withdraw the serious charges that she had brought against the accused. Accordingly, the charges were downgraded to assault and criminal intimidation, and we filed an application in court, seeking its permission to now treat her complaint as a Non Cognisable one. The court granted us permission and the matter was closed,” Mr Thackeray said.
