HC gives 3 months to BMC, State to remove parking under flyovers

The Bombay High Court on Tuesday told the State government and other bodies to remove parking lots under 21 flyovers in Mumbai, Navi Mumbai and Thane.

A Division Bench of Justice Abhay Oka and Justice CV Bhadang also issued notices to the Brihanmumbai Municipal Corporation, Maharashtra State Road Development Corporation and Mumbai Metropolitan Region Development Authority.

The court was hearing a Public Interest Litigation (PIL) filed by Mumbaikar Shaukat Ali that pointed out to the court that though parking was not allowed under several flyovers, not only was the rule flouted, but some also had ‘pay and park’ schemes.

‘Callous’ authorities

The PIL claimed that this “callousness” on part of authorities was in violation of not only the previous order passed by the Bombay High Court but also a government decision of 2008.

The order read, “For security reasons, parking under flyovers should forthwith be discontinued as there is every possibility of destruction of flyovers and the space below flyovers should be given to entrepreneurs for the purpose of beautification/landscaping and maintenance thereof.”

After going through the previous order and the government policy, the court noted that if the State wanted to reconsider its policy, then it could alter it or move the court for modification of its order. The Bench observed that until then, the government would have to act and remove parking under flyovers.
