The Bombay High Court on Friday directed the Maharashtra Pollution Control Board (MPCB) to submit a report on the authentic decibel reading of the noise at the work site of Metro 3 by August 3, and said no metro construction work will be carried out at night.
A Division Bench of Justices Abhay Oka and Riyaz Chagla said till the time the report is out, parties should arrive at a workable solution to keep the rights of the company and also the interests of the larger public in mind intact. “We must note that at this stage we cannot overlook the project of metro which will benefit lakhs of people in the city,” it said.
The court also said that the State government should come up with a grievance redressal mechanism at the earliest to address such complaints which should be dealt with as soon as possible.
The court was hearing a plea filed by a south Mumbai resident, Robin Jaisinghani seeking that the noise caused by Metro work doesn’t exceed noise rules limits, and that no work be carried out from 10p.m. to 6a.m. as it violated fundamental rights guaranteed by the Indian Constitution.
The hearing was adjourned to August 10.
