Abdul Karim murder accused gets life term

The Kozhikode First Additional Sessions Court has sentenced the lone accused, Mohammed Jamsheer, 36, of Vellimadukunnu to life imprisonment and fined Rs.5 lakh for murdering a real estate businessman, Abdul Karim, about six years ago.

Writing the judgement here on Tuesday, Judge A. Sankaran Nair found Jamsheer guilty under Sections 302 (murder) and 201 (causing disappearance of evidence of offence) of the Indian Penal Code. The penalty amount should be compensated to Haseena, wife of Karim. If the accused failed to remit the fine, he will have to undergo additional two more years in prison, the court said.

The prosecution case was that Jamsheer had smothered Karim to a state of unconsciousness in the car parking area of the Jayanthi Building at Palayam on May 15, 2009. He then took him in a car to Nelliangal, near Thamarasserry, under the Koduvally police station limits and burnt the body. The motive of the crime was a dispute between them over the sale of a property at Karuthaparamba and Edavannaparamba.

The charred body was found on a wayside shrubbery by three local residents, Mohammed Ali, Shamsheer and Mansoor, who had helped to push start a car used by the accused at 10.30 p.m. These local residents, who had informed the Koduvally police, had later turned witnesses in the case.

Strong circumstantial evidence was considered in finding the accused guilty of the murder. The prosecution had also presented 42 witnesses, 15 material objects, and 28 documents to be examined by the court.

Investigators had recovered an empty bottle and a match box from Nelliangal. An injury suffered from a human bite on Jamsheer’s arm was another piece of evidence. It was proved that the mark bore the resemblance to the dentition of the deceased.

The car that was used by Jamsheer had been rented from one Mustafa on the previous day of the murder. He had tried to return the car to the owner, but Mustafa refused. Subsequently, Jamsheer abandoned the car at Chevayur. Later, Mustafa surrendered the vehicle at the Koduvally police station.

Both Karim and Jamsheer were into real estate business. The accused also had a mobile showroom on Moideen Palli Road in Kozhikode city.
