HC seeks reason for not arresting accused in a criminal case

The Madras High Court has summoned Tiruvarur Superintendent of Police to explain the reason for not arresting an accused who had allegedly chopped off the right hand of his rival at Sundarakottai Main Road and taken it away in an autorickshaw. The victim died in a hospital in December 2005.

Justice P.N. Prakash directed the SP to be present in the court on August 28 after the complainant G. Senguttuvan, brother of the deceased G. Tamilselvan, approached the court accusing the Inspector of Paravakottai police station refusing to arrest the accused ‘Ullikottai’ Poyamozhi despite having a non-bailable arrest warrant.

The petitioner’s counsel P. Vijendran brought it to the notice of the court that the trial in the criminal case was yet to begin though 13 years had elapsed since the commission of the offence. He pointed out that the complainant was the eye witness to the crime and that he was being threatened by the accused who want him to become a hostile witness during trial.

He also told the court that the prime accused Poyamozhi was a habitual offender and the second accused Elangovan was the president of Ullikottai panchayat when the crime took place. He contended that the police were not showing any interest in arresting the prime accused, despite directions issued by the trial judge to higher officials.
