Proceedings in bail plea stayed

The Madras High Court has stayed for a week all further proceedings in an anticipatory bail plea before the District and Sessions Judge, Nagapattinam, in a case relating to the attack on O.S.Maniyan, AIADMK MP.

Granting interim stay, Justice R.Regupathi, ordered notice to the Voimedu Police Station, Nagapattinam district and others.

In his petition, Mr.Maniyan said on January 28 when he went to preside over a wedding at Marudhur village, he was assaulted by a gang which removed his dhoti and shirt.

Based on his complaint, the police had registered a case against the assailants for charges including attempt to murder. The incident showed that a person could attack anyone and easily escape from the law. The High Court had earlier dismissed the anticipatory bail plea of three accused in the case. Subsequently, one person filed anticipatory bail application and some others a bail application before the District and Sessions Judge, Nagapattinam.

The applications were dismissed on February 17. The Judge later went on leave.

The District and Sessions Judge, Tiruvarur, has been given additional charge of the District and Sessions Court, Nagapattinam. Within five days, the persons whose pleas had been dismissed earlier, have approached the sessions court again with the same prayer.

Mr.Maniyan said he feared he would get only “partial justice” at the hands of the judge. Hence, the present petition.
