Lower court order set aside

The Madras High Court has set aside a lower court order convicting and sentencing an Installation Engineer in a private company to eight years rigorous imprisonment and to pay a fine of Rs.20,000 on charges of subjecting his wife to cruelty and abetting her suicide.

In the order on an appeal, Justice Aruna Jagadeesan said stray domestic quarrels, perfunctory abuses by husbands and in-laws on the deceased, crude and uncultured behaviour of husband like drinking, being mundane matters of normal course, would not go to form and constitute abetment unless these acts of conduct singly or cumulatively were found to be of such formidable and compelling nature as may lead to the commission of offence.
