Directive to Villupuram RDO

The Madras High Court on Monday directed the Revenue Divisional Officer (RDO), Villupuram, to be present in court on June 30 in connection with a writ petition seeking a direction to authorities to issue ‘Malaikuravan' community certificate to the petitioner based on his application submitted in January 2008.

In his petition, minor Prakash, represented by his father Kannaiyan of Arakandanallur in Thirukoilur taluk, submitted that Prakash had secured 1107 marks out of 1200 in the board examination and applied for MBBS for which the community certificate had to be furnished. He had filed documents concerning his family and relatives in which they had been accepted by the State as belonging to the ‘Malaikuravan'community.

To withhold the community certificate after a favourable report from the Tahsildar was unfortunate, the petitioner contended.

In its order, a Division Bench, comprising Justices D. Murugesan and T. Mathivanan, said the court had earlier directed the RDO to file an affidavit for the delay in disposing of the application. The Special Government Pleader had submitted that the affidavit had not been filed and he had not received any instructions. Nevertheless, the affidavit would be filed in a week's time. In such circumstances, the RDO, Villupuram, should be present in the court on June 30. He should file the affidavit and also the counter affidavit.
