Court directive on land in Sembium

The Madras High Court has directed the authorities concerned, including the Chennai District Collector, TNHB and the Chennai Corporation, to complete all formalities with regard to handing over of 5.25 grounds at TVK Nagar, Sembium, to the civic body, by March 12, for expanding its hospital using the funds allocated by the local MLA.

The First Bench consisting of the Chief Justice H.L. Gokhale and Justice K.K. Sasidharan passed the order on a writ petition filed by one L.T. William Moses, a resident of TVK Nagar.

The petitioner said the expansion of the Corporation Hospital was contemplated in the 5.25 grounds.

It was not being taken up in view of the procedural formalities between the authorities despite the fact that the constituency MLA was willing to contribute funds for the purpose from his constituency development fund.

The fund should be utilised by March end.

The Government Pleader said though the land was handed over to the TNHB which in turn handed it over to the Chennai Corporation, the civic body returned it stating that there were encroachments.

Disposing of the petition, the Bench said the Chennai Corporation will receive the land with or without encroachments and take necessary steps to remove encroachments, if any, within two weeks thereafter, by March 26.

This would help the legislator to release the funds in favour of Chennai Corporation, which he may proceed to do right away, in view of the court order.
