Suspended Joint Commissioner of Karnataka Lokayukta Syed Riyaz on Tuesday moved the High Court of Karnataka seeking release on bail in one of the cases related to alleged corruption in the Lokayukta institution.
Justice L. Narayana Swamy, before whom the petition came up for hearing, ordered issue of notice to the Special Investigation Team (SIT), which is probing the cases registered in connection with the alleged corruption.
It was contended in Mr. Riyaz’s petition that there was no complaint against him in the first information report (FIR) registered based on the complaint filed by M.N. Krishnamurthy, an executive engineer with Bengaluru Urban Zilla Panchayat.
Pointing out that the FIR names only one person, Aswhin Y. alias Krishna Rao, the petition claims that the case was registered on the insistence of the Upalokayukta and Superintendent of Police Sonia Narang and there was no ingredient for registration of a criminal case in the statement given by Mr. Krishnamurthy.
There was also a delay in the registration of the FIR as the Lokayukta police, on finding no ingredient to register a criminal case, had sought the view from the Superintendent of Police, the petition claimed.
Contending that all the charges levelled against him were bailable offences, Mr. Riyaz said in the petition that he required better treatment for his ailments for which he was taking treatment in a hospital from where he was arrested.
The Special Court for Lokayukta cases, Bengaluru city, had refused to enlarge him on bail for the reason that investigations are under way.
