Terming that students, faculty and staff members are “the real victims of the in-fight” for the control over management of the city-based Alliance University, the High Court of Karnataka on Wednesday directed the Bengaluru city civil and sessions court to decide the suit related to the dispute over management of the university within six months.
Justice Raghvendra S. Chauhan, in his verdict on the correctness of certain interim orders passed by the civil court in applications filed in the suit, has said that although the fight appears to be between the university and others, the “real fight is between two real brothers [Madhukar G. Angur and Sudhir G. Angur] over management of the university.”
Meanwhile, the High Court said, the “real victims of this in-fight” are the students, the faculty, and the staff of the University.
“It is they who are caught in the crossfire. Thus, it is imperative that the civil suit be decided as expeditiously as possible, and preferably within six months from the date of the receipt of the certified copy of this order. If necessary, to decide the suit within the stipulated period of six months, the trial court shall hold day-to-day hearing of the case,” Justice Chauhan observed.
Meanwhile, the High Court dismissed a petition filed by Mr. Madhukar, who was the first Chancellor of the University and had questioned the August 10, 2016 interim order of the civil court, which had prima facie held that he had no locus-standi to sue anyone on behalf of the university.
Also, the HC did not find fault with the civil court’s order of rejecting Mr. Madhukar’s plea for grant of interim order for restraining Mr. Sudhir G Angur, who is presently the Chancellor of the University, from interfering in the affairs of the university.
Meanwhile, the High Court also set aside certain temporary injunction granted in favour of Mr. Sudhir and others.
While permitting both the sides to make amendments to the pleadings in the suit and applications before the civil court, the High Court asked them to cooperate before with civil court to bring the dispute over management to a speedy end.
