Namma Metro: property owners set for court battle

The Namma Metro Phase 2 work could be in for a court battle, as property owners near Jayadeva Hospital junction are gearing up to take legal recourse. This comes following the notification of 130 properties for acquisition by the Karnataka Industrial Area Development Board (KIADB) earlier this month.

While 22,864 sq metres in BTM layout and Jayanagar 9th Block is sought to be acquired according to the preliminary notification issued on October 9 this year, property owners are yet to receive individual notices after the preliminary notification was effected earlier this month.

“We will file objection to the preliminary notification once it is published in newspapers. So far we have not received any individual notices. All the aggrieved property owners will also seek legal recourse,” said a property owner, whose building has also been notified.

The property owners are up in arms after Bangalore Metro Rail Corporation Ltd. (BMRCL) shifted the alignment to protect a part of the Jayadeva Institute of Cardio Vascular Sciences and Research.

He said that the property acquisition process was being hurried even though the Land Acquisition Act is coming into effect from January 1, 2014.

No integration

Another resident questioned the need to notify the properties even as plans are afoot to build a flyover from Jayadeva Hospital Junction to Silk Board junction, which has been announced in the budget.

“How can BMRCL fix the alignment unilaterally when the flyover project has been announced? There is no integration in efforts between the Bruhat Bangalore Mahanagara Palike and BMRCL, and both lack coordination,” the resident said.

Further, he pointed out that many properties that are notified now could be prevented from being demolished if the alignment is changed to go on the road.
