HC stays transfer of BBMP engineer

The High Court of Karnataka on Tuesday stayed the transfer of an assistant engineer in the BBMP, who had initiated action for demolition of a building put up “illegally” by the husband of a councillor.

Justice N. Kumar passed the interim order on a petition filed by B.P. Paramesh, assistant engineer, Anjanapura sub-division of Bommanahalli zone.

The court also ordered issue of notices to the BBMP Commissioner and Lalitha T. Narayana, councillor of Gottigere ward (No-194). The petitioner alleged that he was transferred due to political pressure from the councillor.

He pointed out that the Assistant Executive Engineer of Anjanapura sub-division had in August received a complaint from an organisation alleging that a building was being constructed without sanctioned plan in Doctors Layout, Kembattahalli Road, Gottigere.

On verification, the petition found that the building belonged to Lalitha’s husband T. Narayana and S. Damodar Reddy. The petitioner had issued a notice asking them to demolish the structure. He claimed in the petition that the transfer order, dated October 14, was issued by the Joint Commissioner, who has no authority to transfer BBMP staff, as such power is vested with the commissioner.
