HC stays joint survey of property behind Mantri Mall

The High Court of Karnataka on Monday stayed for four weeks the Upalokayukta’s order for conducting a joint survey of a property behind Mantri Mall, following a complaint by South Western Railways (SWR) that the developer had encroached upon land owned by the Railways.

A Division Bench comprising Justice N. Kumar and Justice G. Narendar, passed the interim order on a plea filed by Hamaara Shelter Pvt. Ltd. and Abhishek Developers, a partnership firm of Mantri Developer Pvt. Ltd.

The petitioners claimed that the Upalokayukta has no jurisdiction to order a survey by exercising the powers of a civil court as it was a dispute over boundaries of the properties.

The court has ordered issue of emergent notices to the Lokayukta, the State authorities and the SWR. The survey was completed in the absence of the petitioners and report was submitted to the Upalokayukta.

Subway vendors

The High Court also ordered issue of notices to the Bruhat Bengaluru Mahanagara Palike (BBMP) and others on a PIL petition seeking a direction for freeing subways near Kempegowda bus station and the city railway station from unauthorised hawkers and vendors.

A Division Bench comprising acting Chief Justice Subhro Kamal Mukherjee and Justice B.V. Nagarathna passed the order while hearing the petition filed by H. Manjunath, who complained that civic authorities had failed to respond to his pleas.

BBMP elections

A petition seeking a direction to the authorities not to allow two MPs, three MLCs and a nominated MLA to vote in the BBMP mayoral elections was moved in the High Court on Monday.

Former MLA Gulihatti D. Shekhar and two others had questioned the voting rights of Veerappa Moily and D.K. Suresh, MPs, V.S. Ugrappa, Jayamala and Tara, MLCs, and nominated MLA Vinisha Nero.
