The Karnataka High Court on Monday directed the State government to immediately consider the request by the Central Bureau of Investigation (CBI), which had sought sanction from the State for prosecuting certain public servants in the criminal case relating to I-Monetary Advisory (IMA) Group of companies.
Also, the court directed the government to immediately act on the CBI’s request for authorising the agency to carry out the probe under the Karnataka Protection of Interest of Depositors in Financial Establishments Act, 2004.
A division bench comprising Chief Justice Abhay Shreeniwas Oka and Justice Mohammad Nawaz issued the direction after perusing a status report, submitted by Chief Investigation Officer of the Multidisciplinary Investigation Team of CBI probing the IMA case, in a sealed cover on the developments after it took over the investigation on August 30.
As advocates for some of the petitioners pointed out that there was no indication of the action initiated against some politicians allegedly involved in the case, the bench said that it is for the CBI to examine their role while observing that “from the status report of the CBI at this stage, it cannot be said that proper investigation is not being carried out”.
Meanwhile, the bench directed the government to immediately fill up five posts as sought by the competent authority besides taking immediate steps to create 25 more posts as requested by the competent authority for processing claims of over 60,000 investors of the IMA Group.
