Court orders attachment of movableassets of New India Assurance

An Additional District Court and Motor Accident Claims Tribunal has ordered attachment of movable assets of New India Assurance Company Ltd. at its divisional office on Falnir Road here following its failure to deposit the claim amount with the court.

The Tribunal had, on April 15 this year, decreed a motor vehicle accident claim in favour of Sadashiva and his wife Nalini, residents of Kavalpadur, Bantwal, and directed the insurance company to pay ₹ 21.4 lakh compensation with interest and costs. VI Additional District Judge D.T. Puttarangaswamy had ordered that the amount should be deposited with the court within two months.

Lohith, son of the couple, died after a tipper truck hit his motorcycle at Baikampady on National Highway 66 on February 24, 2018. As the truck was insured with New India, a claim was made against the owner as well as the insurance company.

The decree-holder couple filed an execution petition before the court stating that the company had failed to deposit the claim amount with the court as per its direction despite numerous representations and queries.

Consequently, the court issued the order to execute the decree and directed the bailiff to attach all movable assets of the company and return the execution warrant by November 16.
