The Madurai Bench of the Madras High Court on Tuesday observed that meritorious differently abled persons should be given a chance at employment and could not be deprived of an opportunity on the basis of erroneous advertisements.
The court was hearing the plea of a woman with 40% visual impairment who sought permission for appointment to the post of laboratory assistant. The woman from Nagercoil claimed that she had secured the required marks under the special category but was not considered for the post.
The State, in its reply, said the post dealt with chemicals and fragile apparatus and visually impaired persons would not be eligible for such risky posts.
Justice S. Vaidyanathan, hearing the plea, observed that the relief sought by the petitioner could not be granted for the said post and she could not demand the post as a matter of right. However, she should be considered for other posts should she meet the eligibility criteria. Meritorious candidates should be given an opportunity, the court said and disposed of the petition.
