HC stays lower court proceedings against ex-Minister



The Madurai Bench of the Madras High Court on Tuesday stayed proceedings pending before a lower court in Dindigul against former Minister Natham R. Viswanathan.

Justice V. Bharathidasan stayed the lower court proceedings and adjourned the case for further hearing after two weeks. Mr. Viswanathan, in his petition, said the complainant, A. Sabapathi, had alleged that he had failed to return the amount borrowed during the 2014 Lok Sabha election. Out of the ₹ 4.97 crore borrowed, only ₹ 2 crore was returned, the complainant had claimed.

Mr. Viswanathan said though a case was registered by Dindigul police, after due inquiry, it was referred to as a mistake of fact. However, based on a private complaint under Section 200 of the Cr.P.C., the Judicial Magistrate II, Dindigul, had taken up the case against the petitioner.

Claiming that the case was filed against him with a mala fide intention, the former Minister sought a direction to stay all further proceedings pending before Judicial Magistrate II, Dindigul.
