The Madras High Court Bench here has directed the Madurai Superintendent of Police to order registration of a First Information Report (FIR) against a Deputy Superintendent of Police if a complaint lodged against him makes out commission of cognisable offences.
Justice M.M. Sundresh passed the order on a petition filed by A. Thiru Murugan (22) of Tirumangalam taluk accusing Usilampatti DSP K. Saravanakumar of having abused and assaulted him for staging a protest outside Usilampatti Town police station on April 10.
According to petitioner’s counsel S. Vanchinathan, his client met the DSP on the day of the incident in connection with a complaint lodged by his friend P. Ravi, alleging demand of Rs. 20,000 as bribe by Usilampatti Municipal Commissioner for providing water connection.
He alleged that the DSP spoke in support of the Municipal Commissioner. Hence, the petitioner and a few other members of a farmers’ association raised slogans against the police officer.
Irked over it, the DSP reportedly assaulted the petitioner and ordered his arrest in a false case.
After getting released on bail, the petitioner supposedly lodged a complaint with the Superintendent of Police on May 8 and moved the court, seeking a direction to register a case against the DSP on the basis of the complaint lodged by him.
The counsel claimed that the complaint would attract Sections 294b (uttering obscene words), 323 (causing hurt voluntarily), 342 (wrongful confinement), 355 (assaulting a person with the intention of dishonouring a person) and 166 (public servant disobeying law) of the Indian Penal Code.
