Car dealer asked to compensate complainant

Madurai District Consumer Forum has directed a dealer of Tata Motors, Madurai, to pay a compensation of ₹ 1 lakh to a complainant after a vehicle that was used for test drive was sold to him.

The forum, comprising president V. Balasundarakumar and members C. Packialakshmi and M. Maraikamalai, directed the dealer to refund ₹ 57,323 from the sale price of the vehicle and imposed a cost of ₹ 5,000. The forum observed that the vehicle should have been ascertained for road worthiness before being sold. The forum also directed the dealer to address the defects of the vehicle.

The complainant, T. Srinivasan of Madurai, complained that he had purchased an SUV from the dealer of Tata Motors. However, within days, the vehicle developed a snag when he was on a trip with his family. When the vehicle was reported to the service centre it was established that the vehicle was earlier used for test drive and had developed defects.
