Preetha Shaji moves HC for home keys


Preetha Shaji, a homemaker who had been evicted from her property for non-repayment of a loan for which her husband stood surety, has sought to get back the keys of her home from the High Court in view of her remitting a demand draft of ₹43,51,362.85 in favour of standing counsel of HDFC Bank as directed by the court.

The High Court had cancelled the auction of the property and directed Ms. Shaji to pay the amount to the bank.

In a petition filed before the High Court, she said she had paid the amount in compliance with the directive of the High Court to redeem the mortgaged property.

She had, in fact, given a DD for ₹1,89,000 to Ratheesh M.N. who had purchased the property in an auction conducted by the bank. However, he refused to accept it.

The DD was now with her and she was willing to hand it over to Mr. Ratheesh any time.

Besides, she had filed an application before the village officer urging the latter to take steps to put her back in possession of the property.

She also pointed out that the bank informed her that the title deed of the property was with the Debt Recovery Tribunal and it would take time to get it back.
