K. Manikandan, an accused in the Paravur and Varapuzha rape cases, has approached the High Court of Kerala seeking a directive to the State government to order an inquiry into the allegation that Tomin Thachankary, Additional Director-General of Police, misused his powers to falsely implicate the petitioner in the cases.
The petitioner also sought a directive to the Central Bureau of Investigation (CBI) to inquire into his involvement in the Paravur and Varapuzha rape cases. He has also sought a CBI inquiry into the role of Mr. Thachankary in falsely implicating him in the rape cases. The petitioner, who is a businessman and a native of Kanyakumari, said his wife and he had entered into an agreement with APG Developers, Thammanam, for the sale of a property for a consideration of Rs.6.5 crore.
Company shares
Aann Mary, wife of Mr. Thachankary, has 80 per cent shares in the company, which is engaged in real estate development. All the negotiations regarding the sale of the property were carried out by Mr. Thachankary.
After paying Rs.2.5 crore, Mr. Thachankary insisted the petitioner execute the sale deed in favour of the company, and asked him to ignore the balance sale consideration, according to the petition. The petitioner stated that Mr. Thachankary threatened his wife and him that they would be implicated as accused in criminal cases.
The petitioner was taken into custody by the Kerala Police on June 13, 2011, and brought to Kerala for questioning in the Paravur rape case at the instance of Mr. Thachankary. He was arrested the next day in the case.
While in police custody, several police officers asked him to settle the matter with Mr. Thachankary and become free of the case. Mr. Thachankary also assured the petitioner that he would be exonerated from the charges once he executed the sale deed. He also reportedly threatened to implicate him in the Varapuzha rape case.
Later, he was implicated in the second rape case too, the petitioner submitted before the High Court.
