HC orders police aid for Uber drivers, commuters

‘Drivers’ union compelling commuters not to use app’

The Kerala High Court on Wednesday directed the District Police Chief (Kochi City) to provide sufficient and meaningful aid to commuters, drivers, and general providers of Uber app to enable them to use the mobile app for availing the taxi aggregator’s services in the city.

The court passed the directive allowing petitions filed by Uber India System Private Limited and a Uber driver in the city seeking police protection. According to the petitioners, members of Self Employed Drivers’ Union (AITUC) were compelling commuters and drivers not to use the app.

Justice P.B. Suresh Kumar also directed the District Police Chief to evolve appropriate and suitable measures to prevent members of the Self-employed DriversUunion from causing obstruction to commuters and general providers of Uber app or causing injuries or damage to their vehicles.

The court directed the police to invoke provisions of the Kerala Prevention of Damage to Private Property and Payment of Compensation Ordinance 2019 against the perpetrators and those who called for protest, in case any damage is caused to the property under the guise of protest.

The government pleader submitted that it was not practical for the police to provide aid to uber drivers who come to approximately about 4,000 in number.
