State defends Mohanty’s extension

A Division Bench of the High Court comprising Chief Justice Kalyan Jyothi Sen Gupta and Justice P.V.Sanjay Kumar on Friday heard the arguments on behalf of the State government and the Chief Secretary in cases filed questioning the extension granted to P.K.Mohanty as Chief Secretary. Further arguments will be heard on Monday.

Two separate writ petitions were filed by Chandramouliswar Rao and Consumer Guidance Society represented by Diwakar Babu contending that the extension for Chief Secretary can be given only after the State Cabinet takes a decision. They complained that without such Cabinet decision the extension was granted. The State government on Friday contended that in peculiar circumstances the Governor is empowered to act for the sake of system. P.K.Mohanty contended that in such writ petitions the earlier instances of reprimand etc., can not be considered and cases have to be dismissed.
