A twelve-year-old legal wrangle over land acquisition near Kandlakoya junction of Outer Ring Road has been cleared for HMDA, with the Supreme Court issuing a favourable judgment. The judgment copy was received by HMDA on Thursday.
The apex court has asked the urban development authority to pay compensation according to the basic rate of 2013, which came up to ₹ 75 lakh per acre for lands close to the National Highway, and ₹42 lakh per acre for remotely located lands, a statement from HMDA said.
Earlier, based on court directions, the government had issued an order for a compromise deed with the land owners, according to which compensation for the 56 acres in dispute at Kandlakoya may be calculated as per the Land Acquisition Act of 2013. However, taking a cue from this, the other landowners too impleaded into the case demanding similar compensation. The Supreme Court, however, has ruled that the 2013 Act will not be applicable to lands acquired much earlier.
The judgment has saved HMDA close to ₹ 130 crore, the statement said.
