The Division Bench of the Hyderabad High Court comprising Acting Chief Justice Ramesh Ranganathan and Justice T. Rajini on Wednesday suspended the orders of the National Green Tribunal, Chennai, regarding the Palamuru Ranga Reddy Lift Irrigation Scheme.
The Bench was dealing with a writ petition filed by Telangana State government. The government challenged the orders of the Chennai Bench of the NGT which had appointed a committee to visit the project pertaining to Palamuru Ranga Reddy District Irrigation Scheme to ascertain whether these works are meant for drinking water scheme or for irrigation also. It may be recalled that one Harshavardhan Reddy had approached the NGT contending that in the name of drinking water scheme, huge irrigation project work was being taken up in violation of environmental laws as well as Forest Conservation Act.
The NGT Bench appointed a committee to ascertain the facts. The Telangana government had challenged this order in Hyderabad High Court and contended that the judicial member of the tribunal passed this order whereas the rules mandate that a technical expert should also be on the Bench. The HC Bench took into consideration this aspect and stayed the operation of the tribunal. The Bench made it clear that this interim order will not preclude the NGT from passing similar order when the expert member is present on the bench.
Order on AP NGO Bhavan
Justice S.V.Bhatt of Hyderabad High Court on Wednesday stayed the operation of orders of the district Collector, Hyderabad allotting one portion of AP NGO Bhavan, Gunfoundry to Bhagyanagar Telangana NGO Association.
The Judge was passing these interim orders in a writ petition filed by Ashok Babu representing APNGO Association. The petitioner contended that the State government had passed these orders unilaterally and allotting one portion of the APNGO Bhavan to city wing of Telangana NGOs Association which was not correct. It was averred that this was a private building. “The orders of the district Collector pursuant to the decision of the government were illegal.” The Judge granted stay of the orders of the government and the district Collector and directed the respondents to explain the circumstances under which such an order is passed and directed the authorities to file counter affidavit.
Group I services
Justice M.S.Ramachandra Rao of Hyderabad High Court on Wednesday admitted a petition challenging the provisional list of candidates for the Group I services on the basis of the written test conducted by the Telangana Public Service Commission. The judge was dealing with a writ petition filed by Srikanth and others. The Judge made it clear that all further proceedings with regard to the recruitment pursuant to the notification would be subject to the outcome of the final orders in the writ petition. The petitioners alleged that the respondent authorities have resorted to irregular methods for preparing the provisional list in contravention of the specific orders of the Supreme Court with regard to Group I recruitment. The case is adjourned by three weeks.
