Proceedings to be video-recorded for evidence in court

Finally, the farm labourers of Toguta can heave a sigh of relief. The government has assured the High Court that it would conduct a Grama Sabha in the village on November 20. Authorities will notify on November 4 and 5 in this regard, giving 15 days’ time.

Toguta is one the villages where large chunks of land will get submerged under Mallannasagar, but the village will be intact. As a result, farm labourers will become jobless while farmers have sold their lands to the government for construction of the project.

Demanding that the government resettle them as they lost their livelihood, some farm labourers had approached the High Court. P. Laxmi and 28 others in a writ petition number 15444 of 2018 questioned the rationale behind acquiring the land without extending Rehabilitation and Resettlement for them. From the beginning, the State government was reluctant to extend them benefits stating that the village was not submerging.

With the direction from the High Court, the authorities held house-to-house survey in the village.

Justice A. Rajasheker Reddy and Justice P. Naveen Rao were present.

“Special Government Pleader informs the court that the door-to-door survey was conducted in Toguta village on 21-10-2019 and further steps have to be taken by the government. Special Government Pleader requests time to comply with the requirements,” read the order issued by the High Court on October 25, 2019.

It has further stated: “Administrator for Rehabilitation and Resettlement shall comply with the requirements and notify the convening of Grama Sabha by giving 15 days’ time, which shall be on 20.11.2019. Thereafter further steps shall be taken.

The same shall be reported to this court by the next date of hearing. The proceedings of Grama Sabha shall be video recorded and kept with the Administrator, and as and when required, the same shall be produced before the court.”

The case was posted for 22 November, 2019.
