A division bench of High Court of Judicature at Hyderabad comprising Acting Chief Justice Ramesh Ranganathan and Justice Shankar Narayana on Friday directed the Telangana Government to grant permission to the B. Ed. colleges whose cases were cleared by the National Council for Teachers Education (NCTE).
It was dismissing appeals filed by the Telangana Government and confirming the decision of the single judge. The Government said that it would not accord permission though the NCTE had given clearance as the State Government has not issued Government Order granting permission under Section 20 of the AP Education Act, 1982 as adopted by the Telangana. This was challenged by the colleges and the single judge found fault with the government.
The judge said: “that once the NCTE had granted recognition, it is deemed and implied that it has satisfied itself that the institution in question has adequate financial resources, accommodation, library, qualified staff and laboratory required for proper functioning of the institution for a course or training in teacher-education.”
The judge made it clear that it was not open to the State Government now to refuse permission to the B.Ed. courses set up by the respective petitioners on the ground that there is no adequate qualified staff to impart teacher education in these colleges.
The bench while upholding the order of the single judge concurred with the findings of the single judge that the State Government has no power to reject the prayer of an institution for grant of permission or to overrule the decision of the National Council for Teachers Education (NCTE).
