A Delhi court has acquitted a man of the charge of sexually assaulting a woman as the victim denied her allegation during the trial of the case.
The victim, who worked as a maid in the office of the brother of the accused, said she had lodged the complaint against him as she was annoyed with him for refusing to open a ‘zero balance’ account in her name. He had promised to open the account for her.
The victim, a mother of four children, got acquainted with the accused at his brother’s office. Her husband is a rickshaw puller.
On the day of the incident at Najafgarh in West Delhi, the accused allegedly took her near Najafgarh Bus Depot in his car to open her account. However, he took her to a room at Dichaun village and sexually assaulted her, the prosecution had alleged.
It had further alleged that the accused threatened the maid that she would be defamed if she disclosed the incident.
The police on the basis of the above-mentioned statement had lodged the complaint against the accused. The investigating agency had also recorded her statement before a Metropolitan Magistrate under Section 164 of the Criminal Procedure Code, which is admissible as evidence.
But when she was called to record her evidence in the trial, she denied all the charges against the accused.
“I had stated falsely to the police official in my statement that the accused had raped me as I was annoyed with the accused. In fact, the accused never raped me and he is innocent,’’ the victim submitted before the court.
Acquitting accused Rambir alias Bablu, Additional Sessions Judge Virender Bhat said: “Resultantly, the accused is liable to be acquitted and is hereby acquitted.’’
