Suite was in ‘uninhabitable’ condition

A district consumer disputes redressal forum here has directed Toshali Resorts International to compensate a complainant by paying over ₹36,000 following allegations that a presidential suite booked was in an “uninhabitable” condition.

Holding the resort deficient in services, the consumer panel observed, “The complainant had paid a sum of ₹36,500 for booking of the presidential suite [at the resort] in Puri. But the same being found uninhabitable and shabby in condition, he checked out to some other hotel and made expenses for the other resort.”

“We are therefore of the view that the [resort] did not provide asserted services to the complainant, even after receiving the consideration of ₹36,500 for the same. We, therefore, hold them to be deficient in service and award the [sum] with 9% interest in favour of the complainant,” said the consumer forum.

Complainant Samiran Gupta had alleged that despite paying the booking amount for a presidential suite, on arrival at Puri, the resort had failed to provide the said room.

“Instead of a presidential suite, the complainant was given two interconnected bedrooms — one of which had attached kitchenette. Everything in the room was of extreme poor quality and in run down condition and the bed sheets were worn out and dirty,” read the complaint in the order.

Deplorable standard

The consumer forum further observed, “The accommodation offered to the complainant and his family was of a deplorable standard not at all commensurate with the nomenclature of presidential suite.”

However, denying the allegations put forth by the complainant, the resort contended that the booking had been made for a deluxe resort and that the accommodation provided was of “high quality”.

Dismissing the contentions made by the resort due to lack of “evidence” placed, the consumer panel directed compensation to the complainant by January 18.
