Man convicted in rape case

A Delhi court has convicted a man for sexually assaulting a woman on the pretext of getting her a job.

The court held Vinay Dubey guilty of assaulting the woman at his friend’s office in Dwarka North in West Delhi in August this year, solely on the basis of her evidence.

Though counsel for the accused tried to find loopholes in the victim’s evidence, alleging that she had not cited the real name of her husband while recording her statement and that she was in live-in relationship with him, the court rejected this argument. “Merely because she is not legally married to Surender Kumar, whom she treats her as her husband and the fact that she mentioned her husband’s name incorrectly in the statement under Section164 Cr.PC cannot be made a ground to discard her testimony, when it is found that her deposition appears to be true and reliable,” Additional Sessions Judge Virender Bhat stated about her evidence.

The victim was a scavenger at the Delhi airport. However, she later became jobless. So, she was in search of a job. The victim had met the accused a week before the incident. He had promised her to arrange a job for her.

On the day of the incident, the accused called the victim for an interview at his friend’s and assaulted her. But she pushed him away, came out of his room, called the police and lodged a complaint.

Citing a statement of the victim before the court during recording of her statement that she wanted to settle the matter, the defence counsel also alleged that his client had been implicated in the case. But the court dismissed this argument as well, saying that “it may be for various reasons… that doesn’t mean that her complaint against the accused was false.”

“It is thus evident that the accused had called the prosecutrix to the office… only with the intention to satisfy his sexual lust upon her… but could not complete the act only for the reason that the prosecutrix pushed him away and ran out of the office. Therefore, the accused is guilty of having committed the offence of rape. Hence the accused is convicted of the offence under Section 376 (rape) and 511 (attempting to commit offences…) IPC,” the Judge said.
