HC directs college to give admission to student who became eligible after revaluation

The Delhi High Court has directed Lady Shri Ram College for Women to open up a supernumerary seat for a student, who was denied admission to the B.A. (Hons) History but became eligible for the course after revaluation of her marks.

The HC also directed CBSE Chairman and Delhi University Vice-Chancellor to hold a meeting within four weeks and arrive at a method in which the completion of the revaluation process by the CBSE precedes the cut-off date prescribed by DU for admission.

It directed the CBSE to ensure that for the commencing academic year, the re-evaluated marks of students are taken into account while determining the cut-off dates for admission to DU colleges. Noting that “revaluation cannot be an exercise in futility,” Justice Siddharth Mridul ordered LSR to grant admission to Akshita Singh in B.A. (Hons) History course for the academic session 2018-21.

The court declined to entertain DU’s assertion that if admissions are continued indefinitely, due to delayed revaluation of marks by the CBSE, the same will result in delay in commencement of the academic session.

Secured 95.25%

Akshita initially secured 95.25% in the Class XII CBSE examination. She applied for admission to the course in LSR in the general category. Dissatisfied with the marks awarded in history — 91 — she had earlier applied for revaluation. The CBSE informed her that no mistake was detected in the marks upon checking. Dissatisfied with the result of verification, she applied for a copy of her answer sheets. On June 22, she applied for revaluation of her answer sheets.

On July 5, she received the re-evaluated result from the CBSE, in which the marks in history were increased from 91 to 96. This increased her percentage in the ‘best of four’ subjects from 95.25% to 96.5%.

LSR had on June 19, 2018, declared its first cut-off list for the subject, with 96.50% as the cut-off in the general category. However, LSR refused to grant her admission claiming that admission in the subject in the general category was closed on June 21.

Justice Mridul said despite all seats in the subject being filled by a particular college, the HC can direct DU to create a supernumerary seat. The court said the college, when directed to create a supernumerary seat, is empowered to approach the University Grants Commission for release of additional funds.
