Lodge FIR against Ramprastha Developers: court

Complainants had booked 3 plots by paying the entire amount at pre-launch stage

A Sessions court here has dismissed a revision petition by real estate developer Ramprastha Developers and two of its directors against a Metropolitan Magistrate court ordering lodging of a case against them for allegedly duping investors in a residential project — Ramprastha City — in Gurugram in 2006.

Rejecting the probe report submitted by Vasant Vihar SHO, Metropolitan Magistrate Vijeta Singh Rawat had directed the investigating officer to lodge an FIR against them. “In the considered view of this court, cognisable offences are made out which require thorough investigation as the money trail also needs to be found out. SHO, PS Vasant Vihar, is directed to register FIR...,’’ the MM had said. The complainants — Santosh Mathur and Balbir Singh Mathur — stated that they had booked three plots each by paying the entire costs at the pre-launch stage of the project.

They alleged that the company had not given them the plots till date. Rejecting the revision petition, Additional Sessions Judge Satish Kumar Arora said: “The narrative of the complaint did disclose commission of cognizable offence as punishable... and also of the offences of forgery of documents and of its use. The facts of the complaint are evidently of the nature requiring sustained and thorough investigation into various aspects.” “It [inquiry report] appears more of a statement of defence of the accused persons/ petitioners herein as if the inquiry officer was the mouthpiece of the petitioners. He thought of presenting the facts from the view point of the defence. The conduct of the inquiry officer is deprecated,” the Judge said.
